- By occupying a villa, the registered guest accepts full responsibility for the safety and conduct of all occupants and invitees, including children and non-swimmers. Constant, active adult supervision is required at all times when water features are present.
- No swimming while under the influence of alcohol, drugs, or medication that may impair judgment. No diving, running, or horseplay. Do not leave pools unattended while in use. Remove and safely store any loose furniture or objects that can pose a tripping or submersion hazard.
- The registered guest agrees to assume all risks of use, including but not limited to slips and falls, submersion, drowning, cardiac events, and injuries arising from misuse or failure to supervise.
- To the maximum extent permitted by law, the registered guest releases The Cove, its owners, affiliates, and staff from any and all liability, claims, demands, actions, or causes of action arising out of or related to the use of in-villa water features by the guest or any member of the guest’s party.
17. Public Pools and Common Water Areas — Limited Lifeguard Duty
- Lifeguards may be on duty at designated hours in public pool areas. Their presence does not eliminate inherent risks of swimming. Guests must obey all posted rules and lifeguard instructions at all times.

Participation in beach and open-water activities, including but not limited to swimming, wading, boating, jet skiing, towable rides, snorkeling, fishing, and coastal or offshore tours, is strictly at the guest’s own risk, even when activities are supervised by lifeguards or guided by staff or approved third-party vendors. - Mandatory safety rules apply: wear approved personal flotation devices where required; follow all briefings and instructions; do not participate while under the influence of alcohol or drugs; respect age, weight, and health restrictions; immediately discontinue activity if directed by staff due to weather or safety concerns.

- By taking part in any beach or watersport activity, guests knowingly and voluntarily assume all associated risks and agree, to the maximum extent permitted by law, to release, discharge, and hold harmless The Cove, its owners, affiliates, staff, and contractors from any and all claims for loss, injury, disability, or death arising from such participation, except where caused directly by the gross negligence or willful misconduct of The Cove.
